Costs' recovery against the claimant? Is it a matter of empty pockets?
In our experience the recovery of costs from unsuccessful claimants is sometimes overlooked as statistically claimants are more often successful than defendants. There are a variety of reasons for this and success fees have played their part in the “settling for commercial reasons” stakes.
Winning does happen, and when it does the recovery of costs from claimants is not always straightforward.

Lord Justice Jackson’s Report - Good news or bad for insurers and P & I Clubs?
Claimant’s legal costs have become increasing difficult to predict over the last few years predominantly due to success fees. We defend a high proportion of occupiers’ and public liability cases; these can be difficult to reserve as they do not attract fixed success fees and invariably the claimant enters into a CFA with a 100% success fee.
